1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Coached by Daniella website, mobile applications, online coaching programs, subscriptions, memberships, digital content, and related services (collectively, “Services”). “We,” “us,” or “our” refers to Coached by Daniella, its affiliates, and assigns. “You” or “your” refers to the individual, organization, or entity using the Services.

By accessing or using our Services, you agree to comply with and be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.

2. Eligibility

  • You must be at least 18 years of age, or the legal age of majority in your country.

  • If under 18, you must have the consent of a parent or legal guardian.

  • By using our Services, you represent that you are able to safely participate in fitness programs.

3. Registration

  • Accessing certain Services may require registration for an account (“Account”).

  • You agree to provide accurate, complete, and current information during registration and to update such information to maintain accuracy.​

  • You are responsible for safeguarding your account credentials and all activity under your Account.

  • Notify us immediately if your account is used without authorization.

4. Subscription & Payment

  • Services may be sold on a subscription basis. Subscription fees are set on the website/app and may vary by plan or duration.

  • All subscriptions renew automatically unless canceled prior to the next billing period.

  • Payment is processed through secure third-party payment providers (e.g., Stripe, Trainerize).

  • You agree to pay all applicable fees and taxes, and to provide accurate billing information.

  • Free trials, if offered, will convert to paid subscriptions automatically unless canceled before the trial ends.

  • Refunds are not guaranteed, except as required by local law.​​​

5. Canclation & Refunds

  • You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, unless otherwise specified. Partial refunds for fixed-term subscriptions (e.g., 3 or 6 months) are generally not available, except where required by law.

  • All online services, including access to the app, digital content, or any subscription-based programs, are non-refundable once purchased. By completing your purchase, you acknowledge and agree that these products cannot be returned or re​​​

  • For our online 1:1 coaching programs, we offer a 100% satisfaction guarantee under the following conditions:

    • You have fully participated in the coaching program;

    • You have attended all scheduled check-ins and coaching calls;

    • You have followed all training plans and nutrition guidance provided;

    • You have updated your progress in the app as instructed.

If you meet all of the above requirements and are still unsatisfied with the program, you may contact us within 7 days of completing the coaching program. Upon review, we will issue a full refund of your coaching fee.

6. Health & Safety Disclaimer

  • Fitness, nutrition, and wellness programs carry inherent risks. You assume full responsibility for your participation.

  • Consult a healthcare professional before beginning any exercise or nutrition plan.

  • Coached by Daniella is not liable for injuries, health issues, or outcomes resulting from your use of the Services.

  • Programs are intended for generally healthy individuals; they may not be suitable for all medical conditions, pregnancy complications, or recovery scenarios.

7. Intellectual Property

  • All content, materials, videos, images, branding, and digital resources (“Materials”) are the property of Coached by Daniella or its licensors.​

  • You may use Materials solely for personal, non-commercial purposes.

  • You may not copy, distribute, modify, create derivative works from, sell, or publicly display Materials without prior written permission.

8. User License & Acceptable Use

  • You are granted a personal, non-transferable license to access and use the Services in accordance with these Terms.

  • You must not:

    • Violate any intellectual property rights or copyright.

    • Use the Services for unlawful, fraudulent, or harmful activities.

    • Share account credentials or use automated systems to access the Services.

    • Upload content that is abusive, offensive, defamatory, pornographic, or infringes others’ rights.

  • We reserve the right to terminate accounts or remove content that violates these Terms.

 

9. International Use

  • Our Services are available globally. You are responsible for complying with local laws, taxes, and regulations.

  • We make no guarantee that the Services comply with laws outside our country of registration.
     

10. Limitation of Liability

  • To the extent permitted by law, Coached by Daniella is not liable for direct, indirect, incidental, or consequential damages arising from use of the Services.​

  • Our maximum liability is limited to the amount paid by you for the Services in the 6 months prior to any claim.

 

11. Indemnity

  • You agree to indemnify, defend, and hold harmless Coached by Daniella from any claims, damages, or losses resulting from your breach of these Terms or your use of the Services.

 

12. Consumer Rights

  • Your statutory consumer rights under applicable law (EU, UK, US, NL) remain unaffected.

  • Nothing in these Terms excludes your legal rights as a consumer.

13. Termination

  • We may suspend or terminate your access if you breach these Terms.

  • Termination does not affect accrued rights or obligations.

14. Privacy & Data Protection

  • Personal data is collected, stored, and used in accordance with our Privacy Policy, compliant with GDPR, CCPA, and other applicable privacy laws.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of [Insert country of registration, e.g., Netherlands].

  • International disputes may be subject to local law, but parties will attempt mediation before litigation.

 

16. Changes to Terms
